Juvenile delinquency is an important issue that has attracted the attention of the public and many legal scholars in recent years. By carefully studying the causes and factors of juvenile delinquency, it is possible to help reduce their increasing delinquency statistics. Therefore, studying the criminal responsibility of children and adolescents in any country is a must.
Therefore, in the present study, the criminal responsibility of children and adolescents and their delinquency factors have been investigated with regard to the Penal Code and the Juvenile Violence Investigation Law of Afghanistan and the Islamic Penal Code of Iran. Also, with the passage of the Law on the Protection of Children and Adolescents in Iran and the Law on the Investigation of Juvenile Delinquency in Afghanistan, there are signs of acceptance of a discriminatory criminal policy in dealing with crimes against children in Iranian and Afghan criminal law. Laws that, contrary to its general title, seek to provide special criminal protection to children only by criminalizing certain specific behaviors.
