Human rights are the cornerstone that has opened its way from international documents to the domestic laws of the countries, in particular the constitution laws, and today all the constitution laws, along with the normality of pure political power, have included many human rights standards, including most of the rights of the First generation (civil and political rights) and most of the rights of the second generation (economic, social, cultural rights), but along with these two, recently, the rights of the third generation (solidarity rights) have also been embodied in the constitution laws of many countries, that one of the obvious examples of that is right to the environment. A right that is fundamental to the emergence and manifestation of other human rights and is expressed in many constitution laws in various ways. In this article, we will focus on the concepts and environmental considerations contained in the text of the Constitution of the Islamic Republic of Iran and the fifth Republic of France in order to look at the perceptions of the basic legislators of these two legal systems on the environment, the right to the environment and The elements associated with them.
