By carefully studying the causes and factors of juvenile delinquency, it is possible to help reduce their increasing delinquency statistics. Therefore, studying the criminal responsibility of children and adolescents in any country is a must.<br /> Therefore, in the present study, the criminal responsibility of children and adolescents and their delinquency factors have been investigated with regard to the Penal Code and the Juvenile Violence Investigation Law of Afghanistan and the Islamic Penal Code of Iran. Also, with the passage of the Law on the Protection of Children and Adolescents in Iran and the Law on the Investigation of Juvenile Delinquency in Afghanistan, there are signs of acceptance of a discriminatory criminal policy in dealing with crimes against children in Iranian and Afghan criminal law. Laws that, contrary to its general title, seek to provide special criminal protection to children only by criminalizing certain specific behaviors. بزهکاری اطفال و نوجوانان از موضوعاتی مهمی است که در سال های گذشته توجه افکار عموم و بسیاری از دانشمندان حقوق را به خود جلب نموده است. با مطالعه دقیق علل و عوامل‌ بزهکاری اطفال و نوجوانان، می‌توان به کاهش آمارهای رو به افزایش برهکاری آنان کمک نمود. پس مطالعه و بررسی مسئولیت کیفری اطفال و نوجوان در هر کشوری یک امر ضروری است.<br /> بنابراین در پژوهش حاضر مسئولیت کیفری اطفال و نوجوان و عوامل بزهکاری آنان با توجه و با توجه به کود جزا و قانون رسیدگی تخلفات اطفال افغانستان و قانون مجازات اسلامی ایران بررسی گردیده. همچنین با تصویب قانون "حمایت از کودکان و نوجوانان" در کشور ایران و قانون "رسیدگی به تخلفات اطفال" در کشور افغانستان نشانه های از پذیرش سیاست کیفری افتراقی در برخورد با جرایم علیه اطفال در حقوق کیفری ایران و افغانستان، نمایان گردیده است. قوانین که بر خلاف عنوان کلی آن فقط با جرم انگاری برخی رفتارهای خاص در صدد حمایت کیفری ویژه از اطفال برآمده است. https://www.gahr.ir/article_118827_1684dd5a08a812c8682bde2b13a33c0f.pdf
